The purpose and legal basis for our processing of your personal data

Spanishhomes processes customer and task information to provide our assistance in the purchase, sale and financing of real estate. The basis for our processing of customer and task information is thus first and foremost the agreement with the customer and the need to assist the customer in connection with the purchase, sale and financing of real estate. The basis is also the consent given by asking for our newsletter, standing in our buyer and seller directory, or asking for our assistance.

In addition, we are covered by the Money Laundering Act, which obliges us to carry out a customer knowledge procedure in connection with the solution of a task.

You can find the basis for our processing with regard to the general and special categories of personal data that are included in the customer and task information in the Data Protection Regulation and the Money Laundering Act.

The grounds for our processing of special categories of personal data can be found in Article 9 (1) of the Data Protection Regulation, 2. letter f (determination of a legal claim) and letter g (substantial public interest, including in order to comply with the Money Laundering Act).

We process information on criminal offences pursuant to section 8 (1) of the Data Protection Act. 3 (taking care of a legitimate interest, including for example in order to comply with the Money Laundering Act).

We further apply the basis for the processing of general information, “legitimate interest” in Article 6 (1). 1, letter f, of the Data Protection Regulation in cases where there is disagreement about our work, including if a complaint is raised or a lawsuit is initiated. We do this because we consider that our interest in being able to meet requirements in that context outweighs the data subject’s interest in protecting his privacy. At the same time, it is our assessment that in the event of a complaint / lawsuit, the data subject must reasonably expect us to store and use information about the data subject.

Categories of personal information

We process all types of personal information, including general, confidential and special categories / sensitive personal information. However, we do not collect and process information about criminal offences.

Recipients and categories of recipients

We pass on or transfer your personal information to the following recipients as necessary:

– The relevant parties in the tasks in carrying out our work in connection with the purchase, sale and financing of real estate

– Authorities, if we are obliged to do so

– Our accountant and bookkeeper

– Our data processors: The suppliers of our mail system, our digital signature system and our case and journaling system as well as their possible sub-data processors

Finally, we exchange case and customer information internally, just as we exchange personal data on customers for buyers, sellers, real estate providers, real estate developers, promoters, brokers, agents, banks or other party representatives for the purpose of registering a customer as a customer with Spanishhomes and as part of our fulfilment of the task that we have undertaken for the customer and which, by its nature, involves the exchange of personal data and confidential information.

Transfer to recipients in third countries, including international organisations

We do not pass on or transfer personal information to recipients outside the EU / EEA, unless otherwise agreed in advance with the customer.

Where the personal information comes from

First and foremost, we receive our personal information from our customers when they agree with us that we must provide them with assistance in connection with. with the purchase / sale / financing of real estate. In addition, we may, depending on the circumstances, obtain information from publicly available sources, parties to the case, other advisers or authorities.

Storage of your personal information

We oblige ourselves to keep the records of the agreement, including electronic data, for an appropriate period after the end of the case, which is generally not less than 5 years. We thus also store all personal information for a corresponding period.

Right to rectification (correction)

You have the right to have incorrect information about yourself corrected.

Right to delete

In special cases, you have the right to have information about you deleted before the time of our general general deletion occurs.

Right to limitation of treatment

In certain cases, you have the right to have the processing of your personal data restricted. If you have the right to have the processing restricted, we may in future only process the information – except for storage – with your consent, or for the purpose of establishing, enforcing or defending legal claims, or to protect a person or important public interests.

Right to object

In certain cases, you have the right to object to our otherwise lawful processing of your personal data.

Right to transmit information (data portability)

In certain cases, you have the right to receive your personal information in a structured, commonly used and machine-readable format and to have this personal information transferred from one data controller to another without hindrance.
